When people simultaneously occupy multiple social identities, ascriptions of disadvantage and advantage, as well as our reasoning with them, need to be handled with care. For instance, as various US-American courts have come to acknowledge, we cannot in general reason from the premise that someone has neither been discriminated against as a woman nor as a Black person to the conclusion that they have not been discriminated against as a Black woman. In this article, I show how, by systematising such (...) qualified ascriptions of disadvantage (and advantage), as well as the patterns of reasoning involving them, we can articulate and defend central theses of intersectionality theory in remarkably general terms, and without having to commit to a particular metaphysics of intersectional identity. Contributing to a rising number of Critical Data Studies which seek to understand and critically reflect on the increasing datafication and digitalisation of governance, this paper focuses on the field of school monitoring, in particular on digital data infrastructures, flows and practices in state education agencies. Our goal is to examine selected features of the enactment of datafication and, hence, to open up what has widely remained a black box for most education researchers. Our findings are based on interviews conducted (...) in three state education agencies in two different national contexts, thus addressing the question of how the datafication and digitalisation of school governance has not only manifested within but also across educational contexts and systems. As our findings illustrate, the implementation of data-based school monitoring and leadership in state education agencies appears as a complex entanglement of very different logics, practices and problems, producing both new capabilities and powers. Nonetheless, by identifying different types of ‘doing data discrepancies’ reported by our interviewees, we suggest an analytical heuristic to better understand at least some features of the multifaceted enactment of data-based, increasingly digitalised governance, within and beyond the field of education. A variety of recent work in epistemology employs a notion of normality to provide novel theories of knowledge or justification. While such theories are commonly advertised as affording particularly strong epistemic logics, they often make substantive assumptions about the background notion of normality and its logic. This article takes recent normality-based defences of the KK principle as a case study to submit such assumptions to scrutiny. After clarifying issues regarding the natural language use of normality claims, the article isolates a (...) number of choice points regarding the role of contingency, context-sensitivity and similarity in our theorizing with normality. It turns out that both weaker and stronger logics of normality can be motivated depending on how such choices are resolved. And yet securing logics of normality strong enough for normality to play its envisaged role in epistemology may have unwelcome downstream consequences for the resultant theories of knowledge or justification. This article engages with pragmatic sociology to understand an environmental dispute and its underlying moral issues in a direct-democratic and bottom-up setting. The non-establishment of a planned national park in the Swiss Alps serves as a case study to analyse principles of worth presented in national park negotiations. We point to the complex nature of conservation negotiations and argue that loosely defined ideas of the common good can lead to additional difficulties for a bottom-up project. I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. Qualifications with 'as' or 'qua' are widely used in philosophy, yet how precisely such qualifications work is poorly understood. While extant work on the topic is rife with revisionary assumptions about the nature of individuals, truth, and identity, this article shows that no baroque theory is required to account for such qualifications. I develop and defend a simple theory on which qua-qualifications ascribe relational properties to individuals, and show that the proposal affords a clear metaphysical analysis of the puzzle cases (...) of interest. Moreover, the theory makes adequate predictions about the linguistic behaviour of qua-qualifications and helps us think more clearly about their logic. Since this is more than any extant competing theory can claim, the proposal offers the best account of qua-qualification to date. (shrink)

It is both a matter of everyday experience and a tenet of sociological theory that people often occupy a range of social roles and identities, some of which are associated with mutually incompatible properties. But since nothing could have incompatible properties, it is not clear how this is possible. It has been suggested, notably by Kit Fine (1982, 1999, 2006), that the puzzling relation between a person and their various social roles and identities can be explained by admitting an ontology (...) of social qua objects—objects constituted by, yet distinct from, the persons on which they are based. This article argues that admitting even a rich ontology of such qua objects does not suffice to explain the puzzle cases of interest. Instead, alternative resources are required which, once available, diminish the motivation for adopting an ontology of social qua objects in the first place. The paper concludes by considering whether there remains work for social qua objects in explaining differences in persistence conditions between a person and the social individuals to which they may give rise, but reaches a negative verdict. Social qua objects, if they exist, have little work to do in our theorizing about the relation between a person and their various social roles and identities. (shrink)

A growing consensus in the literature on agentive modals has it that ability modals like ‘can’ or ‘able to’ have a _dual_, i.e. interpretations of ‘must’ or ‘cannot but’ which stand to _necessity_ as ability stands to _possibility_. We argue that this thesis (which we call ‘Agentive Duality’) is much more controversial than meets the eye. While Agentive Duality follows from the orthodox possibility analysis of ability given natural assumptions, it sits uneasily with a wide range of alternative proposals which (...) are unified by the idea that ability requires _control_. In particular, we show that against the background of a control requirement on ability, Agentive Duality can be used to derive absurd predictions featuring this dual. Far from being a purely definitional thesis, Agentive Duality thus affords a new lens through which to assess the long-standing debate between possibility analyses of ability and their discontents. This review summarizes the research on ethical decision-making from 2004 to 2011. Eighty-four articles were published during this period, resulting in 357 findings. Individual findings are categorized by their application to individual variables, organizational variables, or the concept of moral intensity as developed by Jones :366–395, 1991). Rest’s four-step model for ethical decision-making is used to summarize findings by dependent variable—awareness, intent, judgment, and behavior. A discussion of findings in each category is provided in order to uncover trends in the (...) ethical decision-making literature. A summary of areas of suggested future research is provided. What is the impact of mission on ethical business culture? This question was analyzed through a qualitative case study of a large nonprofit organization in the human services industry with a solid history of ethical business practices and consistent use of a values-based decision-making model. This research explored ethical decision making, ethical business culture, and congruence between enacted and espoused institutional values. Institutional values were identified, and the following pair of research questions was examined: To what extent were incongruent values (...) found between espoused and enacted values? To what extent did incongruent values impact the ethical business culture? Incongruent enacted values were present in the culture, but negative impact was diminished by a larger number of congruent enacted values. Additional findings revealed that an intense commitment to the mission by all employees was the common thread that wound throughout the organization’s ethical business culture and essentially abrogated the undesirable effects of incongruent and negative values. This article introduces the concept of epistemic positioning to theorize the relationship between identity-based epistemic judgements and the reproduction of social inequalities, including those of gender and ethnicity/race, in the academia. Acts of epistemic positioning entail the evaluation of knowledge claims based on the speaker’s stated or inferred identity. These judgements serve to limit the scope of the knowledge claim, making it more likely speakers will be denied recognition or credit. The four types of epistemic positioning – bounding (reducing a (...) knowledge claim to elements of personal identity), domaining (reducing a knowledge claim to discipline or field associated with identity), non-attribution (using the claim without recognizing the author) and appropriation (presenting the claim as one’s own) – are mutually reinforcing. Given the growing importance of visibility and recognition in the context of increasing competition and insecurity in academic employment, these practices play a role in the ability of underrepresented groups to remain in the academic profession. The past years have witnessed a growing awareness of the role of institutions of knowledge production in reproducing the global climate crisis, from research funded by fossil fuel companies to the role of mainstream economics in fuelling the idea of growth. This essay argues that rethinking knowledge production for post-carbon futures requires engaging with the co-determination of modes of knowing and modes of governing. The ways in which knowledge production is embedded in networks of global capitalism shapes how we (can) (...) think about the future. The essay argues for an attentivity to the material and infrastructural sides of knowledge production, which will enable us to re-think transition to post-carbon futures in ways that recognize the deep structural, spatial and social inequalities underpinning knowledge production. The article deals with Béla Tarr’s longest film Sátántangó and examines relations between image, time and ways of looking, comparing it to Lászlo Krasznahorkai’s 1985 eponymous novel on which the film was based. It reveals connections between episodes and shots in Sátántangó that lead to a conception of time that passes extremely slowly. It is recurrent—leading toward similar, repetitive situations—but at the same represents an inability to change. The image in this film is often conceived as it is mediated and (...) Tarr frequently uses compositions involving ways of looking through some kind of optical device or a window. The only way of accessing reality is to look at it when there is no real opportunity, will or ability to intervene and change it. In this sense the article shows the relationship between the image of the fictional world of Sátántangó, inhabited by passive and demoralized characters, and the world of the film spectator and his or her relation to film image as such. P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. The resulting chronology is complex, and I here only indicate it in rough form in a way which [End Page 272] brings out what I take to be its major points. Leaving out of account those Socratic" dialogues which Thesleff takes to be latish and the posthumously completed Laws, we can say that a series of late dialogues starts with the Parmenides and includes the Timaeus, Critias, Sophist, Politicus, and Philebus. This book explores the various ways, ranging over psychology, political philosophy and metaphysics, that both historical women and various conceptualizations of the female help shape Neoplatonism, one of the most influential philosophical schools of late antiquity, at various levels.

The notion of trust has been discussed among several scientific fields, but it still lacks the joint theory. The goal was to analyze the trust associations of 600 participants and clarify how people associate the word “trust”. Overall, 600 participants produced 1800 associations which were sequentially divided into five domains and 14 categories. The findings imply, that when it comes to trust people tend to associate it mainly with relationships and positive emotions. The fact that associations involved mainly positive emotional (...) states and significant others may show, that trust in itself is something emotional and obviously bound to people we have the strongest bonds with. It is not easy to find a fair balance between inappropriate speech on the one hand and the appearance of constraint and inaccessibility on the other. Also judges must deal with this difficult task. They must take care not to endanger values that are protected to secure the functionality of justice. This article deals with questions of why and how judges can fulfil this task and what might happen if they fail to do so. The article argues in favour of (...) temperate speech using arguments from the fields of judicial ethics and normative ethics. It also offers examples of intemperate speech that might be dangerous to justice. Last but not least, the article mentions the relevance of judicial temperate speech for the concept of open justice thanks to which the judiciary might seek public confidence. (shrink)

Freedom of Religion, Institution of Conscientious Objection and Political Practice in Post-Communist Slovakia1 The example of Slovakia is used to show how one of the post-socialist countries failed in fulfilling the demanding task of securing freedom of religious belief (including the right to conscientious objection) and, at the same time, securing all other human rights. An analysis of the methods used for changing the policies of pluralism and neutrality of the state into a policy of discrimination (e.g. concerning the registration (...) duty for churches) was carried out, followed by an analysis of a mechanism used for guaranteeing freedom of conscience of the members of the Catholic Church (the so-called Vatican Treaty). The treaty violates the prohibition of discrimination against women, because it makes it more difficult for them to have access to some health care services. Our hypothesis states that the hurriedly introduced right to conscientious objection is misused in this context as a means of regulating the politics of reproduction. In general, the re-Catholisation of the Slovak Republic follows two aims—to help in the fight for votes in the elections (because 70 % of Slovaks declare their religion to be Catholic), and to improve demographic development in the Slovak Republic (declared to be catastrophic by the Catholic Church), through hindering free access to abortions. Contemporary changes in the domain of knowledge production are usually seen as posing significant challenges to ‘the University’. This paper argues against the framing of the university as an ideal-type, and considers epistemic gains from treating universities as assemblages of different functions, actors and relations. It contrasts this with the concept of ‘unbundling’, using two recent cases of controversies around academics’ engagement on social media to show how, rather than having clearly delineated limits, social entities become ‘territorialised’ through boundary disputes. Critical accounts over the past years have focused on neoliberalism as a subject of knowledge; there has been a recently growing interest in neoliberalism as an object of knowledge. This article considers the theoretical, epistemological and political implications of the relationship between neoliberalism as an epistemic subject and neoliberalism as an epistemic object. It argues that the ‘gnossification’ of neoliberalism – framing it an epistemic project, and deriving implications for political engagement from this – avoids engaging with numerous ambiguous elements (...) of the production of knowledge. Drawing on Bourdieu’s concept of the ‘scholastic fallacy’ and Boltanski and Chiapello’s work in sociology of critique, the article lays out a framework for the study of the relationship between epistemic, moral, and political elements of critique of neoliberalism, including the conditions of its own production in contemporary academic contexts. Conversational artificial intelligence (CAI) presents many opportunities in the psychotherapeutic landscape—such as therapeutic support for people with mental health problems and without access to care. The adoption of CAI poses many risks that need in-depth ethical scrutiny. The objective of this paper is to complement current research on the ethics of AI for mental health by proposing a holistic, ethical, and epistemic analysis of CAI adoption. First, we focus on the question of whether CAI is rather a tool or an (...) agent. This question serves as a framework for the subsequent ethical analysis of CAI focusing on topics of (self-) knowledge, (self-)understanding, and relationships. Second, we propose further conceptual and ethical analysis regarding human-AI interaction and argue that CAI cannot be considered as an equal partner in a conversation as is the case with a human therapist. Instead, CAI’s role in a conversation should be restricted to specific functions. (shrink)

This paper presents a proposal for the description of gesture phases derived from articulatory characteristics observable in their execution. Based on the results of an explorative study examining the execution of gesture phases of ten German speakers, the paper presents two sets of articulatory features, i.e., distinctive and additional features by which gesture phases are characterized from a context-independent and context-sensitive point of view. It will be shown that gesture phases show a particular distribution of the features, thus distinguishing one (...) phase from another. Furthermore, changes in the execution of phases in linear successions can be described by means of features. Contrary to other accounts, whose focus on gesture phases is primarily in relation to speech and/or adjacent phases, this proposal concentrates on the visible physical characteristics of gesture phases. Socio-psychological integration is a dimension of integration affecting refugees and receiving community members alike, and is related to those integration goals which promote positive intergroup attitudes, close social proximity, interrelation of social networks, low levels of perceived intergroup threat, positive intergroup contact, etc. The goal of this study was to explore the differences in the levels of indicators of socio-psychological integration in both groups. Six hundred receiving community members in Croatia, and 149 refugees from Syria in Croatia participated in the (...) field study. The results generally show that the refugees have more positive attitudes towards receiving community members, a closer social proximity and lower levels of perception of symbolic and realistic intergroup threat than vice-versa. Intergroup contact in Croatia is very rare, posing an interesting setting for the integration process. Potential implications of these findings are discussed. (shrink)

In this paper, I will first add some thoughts on Cambron-Goulet and Côté-Remy’s analysis of the tension in Plotinus’ and Porphyry’s philosophy between the concept of the soul as genderless and the conceptual link between the soul becoming vicious and the soul becoming effeminate. I will argue that—despite of the emancipatory impulses in their philosophies—both Plotinus and Porphyry stick to conceptual connections which are constitutive for patriarchic discourses, especially to the conceptual link between being human, being male and being rational (...) which makes women “the other.” In the second part of my paper, I will discuss the question of whether the emphasis Plotinus and Porphyry put on the universal nature of the soul helps to explain why they suppress the hierarchy between souls born in male bodies and souls born in female bodies which Plato develops in the Timaeus. I will argue that there is nothing in Plotinus’ conception of the universal nature of soul which principally excludes a hierarchy between the souls of men and the souls of women, so that his emphasis of the universal nature of soul cannot explain his passing over the hierarchy of Plato’s Timaeus. Scientific communities expect early career researchers to become intellectually independent and to develop longer-term research plans. How such programs emerge during the early career phase is still poorly understood. Drawing on semistructured interviews with German ECRs in plant biology, experimental physics, and early modern history, we show that the development of such a plan is a research process in itself. The processes leading to IRPs are conditioned by the fields’ epistemic practices for producing new knowledge. By linking the conditions under (...) which ECRs work to the epistemic properties of their IRPs, we identify mechanisms that produce these programs and conditions facilitating or hindering the operation of these mechanisms. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

Barbara Vetter proposes that certain epistemic and metasemantic challenges to our theorizing about metaphysical modality can be met by an approach which generalizes from every day paradigms of objective modality – notably the abilities and dispositions familiar to us “from the context of action” – to give content to the more abstract notion of a most general objective modality: metaphysical modality. I argue that the ability ascriptions which are central to our day to day practical reasoning are permeated with opacity (...) and therefore make for problematic paradigms of an objective modality. While Vetter could retrospectively “purify” her sample of paradigms, this would leave her in a similar position as those who seek to restrict a particularly broad modality, e.g. a priori conceivability, to its objective core. I conclude by taking on Vetter’s pessimistic conjecture that proponents of different approaches to the metasemantic challenge operate under assumptions so dramatically different that we should not expect them to even share a subject matter. Against this, I give an argument which suggests that so long as there is agreement regarding the theoretical role of metaphysical modality, it would be surprising if it made a difference whether one approached metaphysical modality by generalizing from one well-understood modality rather than by restricting another.
